At this time of year, inquiries are usually made as to who should pay for the expenses incurred as a result of the start of the school year. Books, school supplies, uniforms, activities ... Which of the two parents is in charge of these expenses?
Per Sílvia Pinilla / Lawyer and Head of the Family Law Department
First of all, we need to know whether the Judgment regulating custody and custody makes express reference to the payment of such expenses. If so, the costs will be paid in accordance with the provisions of the Judgment.
In the event that the Divorce Judgment does not rule on this matter, the expenses for the start of the academic year must be paid with the alimony. That is, they will be paid by the parent who receives child support from the children, as the jurisprudence considers the expenses of the beginning of the school year as ordinary expenses and are therefore included in the pension.
These are foreseeable and recurring expenses, so they will have to be paid with alimony.
